RECENT REPRESENTATIONS OF CLIENTS RELATING TO CHINESE AND OTHER ASIAN MATTERS
? Counseled on major financing agreements for mergers and acquisitions, debt restructuring and syndicated credits for clients in China, as well as Indonesia, Thailand, Malaysia, Singapore, Australia, Korea and Japan.
? Counseled on a $2.3 billion SEC-registered global ADR offering and NYSE and London Stock Exchange listing for CINPOEC, the major Chinese petroleum refining company.
? Assisted in drafting the 1996 Chinese Partnership Law.
? Represented a U.S. party negotiating a joint venture involving a brewery in
Liaoning Province.
? Litigated a multimillion dollar case on behalf of the Bank of China against the government of Iraq in Bank of China v. Central Bank of Iraq (S.D.N.Y. 1997).
? Litigated a multimillion dollar letter of credit case against a Canadian company on behalf of the Bank of China.
? Successfully defended CITIC, a Chinese bank, in a preference action brought by Enron (S.D.N.Y. Bankruptcy Court).
? Represented a Taiwanese technology company in a complex international arbitration regarding investment in a U.S. company.
? Successfully defended a Chinese mineral and metal exporter in a U.S. court.
? Represented a computer systems hardware manufacturer in a collection matter and joint venture disputes with American public companies listed on the major New York stock exchanges.
? Recovered over $200 million in cash and collateral from an insolvent tanker fleet on behalf of a major Asian trading house and supplier.
